Terms of Service

These Terms of Service ("Terms") govern your use of the NavCast mobile application ("App") provided by Motorwise.io ("we", "us", or "our"). By downloading, installing, or using the App, you agree to these Terms.

1. Acceptance of Terms

By accessing or using NavCast, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and agree to be bound by these Terms and our Privacy Policy.

2. Important Safety Disclaimer

NavCast is a data routing tool only. It is not a substitute for official nautical charts, proper navigational equipment, sound seamanship, or good judgement.

• Do not use NavCast as your primary means of navigation.
• NMEA data may contain errors, lag, or dropouts. Always cross-check instrument readings with independent sources.
• Do not rely solely on data routed through NavCast for collision avoidance, anchoring decisions, or passage planning.
• The skipper is responsible for the safe navigation of the vessel at all times.

3. License

We grant you a limited, non-exclusive, non-transferable, revocable licence to use NavCast on devices you own or control, subject to these Terms.

4. Restrictions

You agree not to:

• Reverse-engineer, decompile, or disassemble the App, except as permitted by applicable law
• Redistribute, sublicense, or resell the App or its data
• Use the App for any unlawful purpose
• Remove or alter any proprietary notices or labels

5. Data Routing

NavCast routes NMEA sentences between inputs and outputs on your device and local network. We do not guarantee the accuracy, completeness, or timeliness of any data passing through the App. It is your responsibility to verify instrument data independently.

NMEA data is transmitted unencrypted over TCP and UDP, as this is inherent to the NMEA 0183 protocol. You are responsible for securing your local network.

6. Map Data

Map tiles are provided by third-party services (CartoDB/CARTO, OpenSeaMap, Wikimedia, and Esri/GEBCO) under their own licences. We do not guarantee the accuracy or availability of map data.

7. Background Service

The App runs a foreground service that continues operating when the screen is off or the App is in the background. It may auto-start on device boot if configured by the user. This is necessary for continuous data routing but may affect battery consumption.

8. Limitation of Liability

To the maximum extent permitted by law, Motorwise.io and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to:

• Data loss, corruption, or routing errors
• Navigation errors arising from reliance on routed data
• Loss of equipment or property damage
• Personal injury resulting from use of the App

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Indemnification

You agree to indemnify and hold harmless Motorwise.io from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

11. Termination

We may suspend or terminate your access to the App at any time if you breach these Terms. Upon termination, your licence to use the App ceases immediately.

12. Open-Source Components

NavCast incorporates open-source software components, each provided under its own licence. A list of these components and their licences is available in the App under Settings > Open-source licences.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Motorwise.io regarding the use of the App.

16. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or this page. Your continued use of the App after changes constitutes acceptance.
